A "special use" may be permitted in certain zoning district classifications, provided that it can meet the standards and conditions specified in the Unified Development Code. Uses subject to this permit are those that have strong potential to conflict with surrounding uses if not appropriately designed and sited on a property. Each zoning classification has a list of uses that may be considered under a Special Use Permit. Proposed projects will be reviewed for compliance with the Comprehensive Plan, all City codes and standards, and compatibility with the surrounding neighborhood.
Procedure:
First, contact the Land Use Division of the Department of Community Development and schedule a pre-application meeting to review your conceptual drawings and the City’s requirements and procedures. Then submit a completed application form, along with any required plan and support documents as determined at the pre-application meeting. Required plans and information for a Special Use Permit application may vary depending upon the nature of the request. Special Use Permit applications that involve building a new structure will also require preliminary and final plan approval prior to applying for a building permit. Applications may be filed at the Planning and Development Department any time between the hours of 8 a.m. and 5 p.m. on or before the filing deadline date. Late submittals will be placed on the next available agenda.
If the applicant is anyone other than the fee simple owner, an affidavit must be filed at the time of application with the signature of the fee simple owner designating the applicant as the authorized agent for all matters concerning a rezoning and/or special use request. The project will be reviewed for compliance with the Comprehensive Plan, all City codes and standards, and compatibility with the surrounding properties.
After the City staff reviews your submittal and you have responded to staff comments, your case will be heard by the Planning Commission, who will conduct a public hearing. The Planning Commission will make a recommendation for approval, approval with conditions, or denial to the Governing Body, who will then make the final decision. Expiration of Special Use Permit:
Based upon the type and magnitude of the use being requested, a time limit may be imposed on the Special Use Permit. In these cases, a new Special Use Permit application and required information must be submitted on or before the expiration date.

A non-refundable application fee is due at the time the application for special use permit is submitted. The fee is based on the following:
